Terms of Service

These Terms of Service (“Terms”) are a legally binding agreement between you and PointMe governing your access to and use of the platform available at pointme.cc. By using our Service, you confirm you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must discontinue use immediately.

1. Eligibility

To use our Service, you must:

  • Be at least 13 years of age (users between 13–18 must have parental or guardian consent).
  • Have the legal capacity to enter into a binding agreement under applicable Nepali law.
  • Not be barred from using the Service under any applicable law or regulation.
  • Provide accurate and complete information during registration.

2. Account Registration and Security

To access full features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password confidential and secure.
  • Notify us immediately at legal@pointme.cc if you suspect unauthorized account access.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.

3. The Service

Description

PointMe provides a link-in-bio platform allowing users to create a single, customizable page containing multiple links, accessible via a unique URL (e.g., pointme.cc/yourname), shareable across social media and other digital channels.

  • Creation and management of a personalized link-in-bio page
  • Addition of unlimited links
  • Full customization of page appearance and branding
  • Real-time click analytics and traffic data
  • Ad Revenue Sharing Program (optional — see Section 8)

Availability

We strive to maintain continuous availability but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance and will make reasonable efforts to notify users in advance.

4. User Content

Your Content

You retain full ownership of all content, links, text, images, and materials you publish through the Service (“User Content”). By posting User Content, you grant us a non-exclusive, royalty-free, worldwide license to host, display, and distribute it solely for the purpose of providing and improving the Service.

Content Standards

Your User Content must not:

  • Violate any applicable Nepali law or regulation
  • Infringe any intellectual property rights of any third party
  • Contain false, misleading, or deceptive information
  • Promote, facilitate, or glorify illegal activities
  • Contain obscene, defamatory, hateful, or discriminatory content
  • Violate any individual's right to privacy
  • Contain malware, viruses, or malicious code
  • Violate the Advertisement Act, 2019 or any consumer protection regulation

Our Rights Regarding Content

We reserve the right to remove or disable access to any User Content that, in our sole discretion, violates these Terms or applicable law, without prior notice. We are not obligated to monitor User Content but may do so.

5. Prohibited Activities

You agree not to:

  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Service to distribute spam, phishing links, or unsolicited communications
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated bots, scrapers, or tools to extract data without permission
  • Engage in any activity that disrupts or interferes with the Service's performance
  • Circumvent any security or access control measures
  • Use the Service for money laundering, fraud, or any criminal activity

6. Intellectual Property

Our Property

The PointMe name, logo, platform design, software, and all related intellectual property are owned by or licensed to us. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary materials without prior written consent.

Feedback

If you provide feedback or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.

7. Fees and Payments

Free Tier

We offer a free tier with access to core features. No payment is required to create and maintain a basic PointMe page.

Premium Features

We may offer optional premium features or subscriptions for a fee. Pricing, billing cycles, and features will be clearly disclosed at the time of purchase.

Payment Terms

  • All fees are stated in Nepali Rupees (NPR) or as otherwise indicated.
  • Payments are processed through secure third-party payment gateways.
  • We do not store your full payment card details.
  • All sales are final unless otherwise stated or required by the Consumer Protection Act, 2075.

Taxes

You are responsible for all applicable taxes, duties, or levies. We will collect Value Added Tax (VAT) where required by Nepali law.

8. Ad Revenue Sharing Program

Overview

When your PointMe page reaches a certain level of traffic and meets our eligibility criteria, you will receive an option to participate in our Ad Revenue Sharing Program. Participation is entirely voluntary.

How It Works

  • Eligibility is determined by us based on traffic thresholds and other criteria.
  • When your page becomes eligible, you receive a notification and the option to opt in.
  • If you opt in, advertisements may be displayed on your page.
  • You receive a percentage of ad revenue generated from your page, disclosed at opt-in.
  • No spending is required to participate — it is a monetization opportunity, not an ad purchase.

Program Terms

  • We may modify, suspend, or terminate the Program at any time with reasonable notice.
  • We determine ad content displayed. You may not interfere with ad placement or generate artificial clicks.
  • Revenue payments are subject to minimum threshold requirements and payment cycles.
  • We reserve the right to withhold payments in cases of suspected fraud or Terms violation.
  • Participation is subject to compliance with the Advertisement Act, 2019.

Tax Obligations

You are solely responsible for reporting and paying any taxes applicable to revenue earned through the Program, in compliance with Nepali tax law.

9. Termination

Termination by You

You may terminate your account at any time by contacting us or using the account deletion option in your settings. Your page will be taken offline and your data handled as described in our Privacy Policy.

Termination by Us

We may suspend or terminate your account at any time, with or without notice, for reasons including violation of these Terms, provision of false information, illegal or fraudulent activity, non-payment of fees, or at our sole discretion.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law. Provisions that by their nature survive termination shall remain in effect.

10. Disclaimers and Limitation of Liability

Service Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by Nepali law.

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total aggregate liability for any claims shall not exceed the total amount you have paid us in the 3 months preceding the claim.

Consumer Protection

Nothing in these Terms limits or excludes rights you may have under the Consumer Protection Act, 2075 of Nepal that cannot be excluded or limited by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless PointMe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your violation of these Terms, your User Content, your violation of any third-party rights, or your violation of any applicable Nepali law.

12. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of Nepal, including the Contract Act, 2056, Electronic Transactions Act, 2063, and Consumer Protection Act, 2075.

Dispute Resolution

In any dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the competent courts of Kathmandu, Nepal. Nothing in this clause prevents you from seeking emergency injunctive relief from a court of competent jurisdiction.

13. Changes to These Terms

When we make material changes, we will:

  • Update the "Last Updated" date at the top of these Terms
  • Notify you via email or a prominent notice on the Service
  • Seek your renewed consent where required by applicable law

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.

14. Miscellaneous

  • Entire Agreement — These Terms and our Privacy Policy constitute the entire agreement between you and PointMe regarding the Service.
  • Severability — If any provision is found unenforceable, the remaining provisions continue in full force.
  • Waiver — Our failure to enforce any provision shall not constitute a waiver of that right.
  • Assignment — You may not assign your rights without our prior written consent. We may assign ours without restriction.
  • Language — These Terms are written in English. In any conflict with a translated version, the English version prevails.
